The Monadnock Rod and Gun Club has yet to make any payments toward the more than half-a-million dollars in damages awarded to its neighbor, after the club illegally extended its shooting range onto the adjacent property, including filling in wetlands.

The Monadnock Rod and Gun Club has not been in operation since 2018, when the town of Peterborough issued a cease and desist after discovering the club had made several zoning violations. The town, along with neighboring property owners, sued the club for damages and fines for filling in wetlands and constructing a shooting range that encroached onto the property of Scott and Bridgette Perry.

The Perrys won their case in April of 2020, and the club was ordered to pay $650,000 in damages to restore wetlands on the property. But those payments have yet to start, according to L. Phillips Runyon, attorney for the Perrys.

The Perrys have not yet actively pursued reparation payments, as until December, the club was still tied up in a separate battle with the Town of Peterborough, which was seeking zoning violation fines. However, Hillsborough North Superior Court Judge David Anderson ruled in a summary judgement issued Dec. 8 in favor of the town, awarding Peterborough $3,575 to be paid by the club.

Ken Caisse, President of the Monadnock Rod and Gun Club, said in an interview Thursday that the club has not made any decisions about how to move forward with the payments, but is scheduled for a club meeting on April 12, and will discuss the matter at that time.

Runyon said he has not been in contact with members of the club since the conclusion of the Peterborough suit in December, noting that the Perrys suit had been “treading water” waiting for the town’s matter to conclude. He said he would be teaming up with John Ratigan, the attorney representing Peterborough, to coordinate the next steps in the process.

“They don’t have further recourse for appeal. These judgments are now final, so the only issue that remains is how they are going to pay. Those are some big numbers,” Runyon said.

The Perrys have an attachment lien on the gun club property, so if it were to be sold, the Perrys judgement would be paid from the sale of the land. No schedule has been set for the payment of the judgment for the Perrys.
