SANDUSKY, MI - A thumb-area restaurant staying open in defiance of a statewide health order is no longer a Big Boy franchise, so its owners are mulling how to sell off its statue of the restaurant’s mascot.

Some collectors place a high value on memorabilia like the Big Boy statue and there’s been a lot of interest, said part-owner Troy Tank, who is considering selling the statue to the highest bidder or raffling it off to give a more equal chance to anyone interested. Tank said his restaurant owns the statue.

However, the statue is very low on the owners’ list of priorities.

The restaurant is accruing a fine of up to $1,000 for each day it remains out of compliance with the order, which forced restaurants to shut down in-person dining spaces for three weeks. Big Boy corporate prepared to take legal action against the restaurant after condemning its decision to violate the order, but the restaurant had no intention of backing down, Tank said.

The parties voided the franchise agreement last week, according to a post on the restaurant’s Facebook page. Tank compared the situation to an amicable divorce and said ending the franchise agreement was a good move for both parties.

“It was a great 35-year run,” Tank said. “We had talked about stepping away from Big Boy in the past few years, the corporation as a whole has just gone a few different directions (from us).”

No longer affiliated with the chain, the restaurant is considering a contest of sorts to let its patrons decide on a new name, Tank said. It will also have to create its own menus without any Big Boy signature food items and find comparable suppliers, Tank said, though he plans to serve similar types of food.

“It’s gonna be a transition on the fly, “ Tank said. “We’re not gonna close down and completely stop being open for a few days, that would kind of defeat the purpose of what we’re doing to begin with.”

Tank declined to comment on the state of the restaurant’s legal situation and directed questions to lawyers who are handling it.

A GoFundMe page set up by the restaurant has brought in more than $11,000 as of Wednesday, Nov. 2.

“For now we’re going to try to keep going, keep serving food because it’s been a crazy ride,” Tank said.

The Sanilac County Health Department could not immediately be reached for comment.
