Letters: Waiver of $20k contractual payment may violate state law

We have a copy of a memo signed by Newark Public ServicesDirector Dave Rhodes, on his letterhead, waiving a $20,000 required contractual contribution to the Licking County Foundation for payments for a scoreboard. The $20,000 Rhodes waived belonged to the people of Newark and the waiver violated both a contractual obligation and Ohio Revised Code §309.12.Can the citizens of Newark ever expect to obtain justice from Mayor Jeff Hall and a City Council composed entirely of Republicans? Even as a Republican myself, I think not!

Can the citizens of Newark expect justice from Ohio Auditor Keith Faber? Seems unlikely. The Republican who leads the state auditor’s office has not even responded to a request by the Licking County Prosecutor's Office to look into the matter after nearly 3 months!

It certainly seems that protection of the Republican Party’s image is more important than exposing misuse of public funds. Failure to expose this abuse is an open invitation for further abuse.

Fortunately, according to the Ohio Revised Code §309.13: “… if for any reason the prosecuting attorney cannot bring such action (violation of a contract under §309.12), ”… a taxpayer, upon securing such costs, may bring such suit, or institute such proceedings, in the name of the state ... Such action shall be for the benefit of the county, as if brought by the prosecuting attorney.”

So, as a taxpayer in Licking County, I will seek legal counsel on how to proceed to expose this deceptive action under ORC §309.13.
