Chick-fil-A has agreed to pay a $4.4 million settlement to customers who accused the fast food restaurant chain of inflating menu prices for delivery orders, according to reports.

The class action lawsuit against Chick-fil-A was filed Oct. 3 in the U.S. District Court for the Northern District of Georgia. The complaint claimed the company advertised low-cost food delivery, but then raised product prices for delivery orders only, compared to in-store prices.

The settlement, which was first reported by TopClassActions.com, includes a $1.45 million cash fund and $2.95 million gift card fund.

“On delivery orders only, Chick-fil-A secretly marks up food prices for delivery orders by a hefty 25-30%,” the complaint states, according to Insider. “In other words, the identical order of a 30-count chicken nuggets costs approximately $5-6 more when ordered for delivery than when ordered via the same mobile app for pickup, or when ordered in-store.”

Chick-fil-A, which did not admit guilt in the settlement, agreed to add a disclosure on its website and app notifying customers product prices may be higher for deliveries.

In addition, Chick-fil-A agreed to provide email addresses of potential class action members to the settlement administrator so they can be directly notified of the settlement. The company will also place a settlement notice on its website, according to TopClassActions.com.

Those who meet the eligibility requirements will be directly notified by an email from the settlement administrator, and are expected to receive either a cash payment or gift card, each totaling $29.95. However, if the $4.4 million settlement fund isn’t enough to cover all claims, proportionate payments will be made to affected customers.

There will also be an online settlement claim form where potentially affected customers can enter their name, email address, phone number, and proof they are an eligible class member in the Chick-fil-A settlement. While the claim form is not yet live, customers can check TopClassAction’s website for future updates.
